MILLENICOM Customer Account Terms and Conditions
Statement of Responsibility for Mobile Broadband Service
(Applies to mobile broadband accounts only)
I agree to the following conditions regarding use of mobile broadband service:
International Rates- Use of our service outside the US and Puerto Rico will accrue extremely high roaming charges which will automatically be applied to the users system of payment. Use of mobile broadband service near International borders may inadvertently connect to towers located outside the United States. I understand it is my responsibility to turn off any roaming ability when I take this device outside the US or near its borders.
Use of any Millenicom service for other than its prescribed purpose is prohibited. Charges plus penalties will immediately be applied to the users system of payment.
Millenicom customers are to exclusively use the technical support and customer service options provided by Millenicom for any service or product provided by Millenicom.
We reserve the right to deny, terminate, disconnect, modify or suspend wireless data Service if a Wireless Data device engages in the following prohibited uses: public wifi, broadcast to multi-dwelling units or extraordinary usage such as server devices or host computer applications, including, but not limited to, disproportionate Web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections, peer-to-peer (P2P) file-sharing applications broadcast to servers or recipients such that they could enable “bots” or similar routines.
DISCLAIMER
Agreement- Millenicom is an interactive online service provider for access onto the Internet. This agreement sets forth the Account Terms and Conditions that apply to the subscriber for use of Millenicom. The subscriber is deemed to have agreed to comply with all terms by use of the service.
Billing Period- All services provided by Millenicom will be billed in advance for the forthcoming month. Credit card authorized payment will also be billed in the same manner. Payments for annual, semi-annual and quarterly accounts not received by the anniversary date will have their account put on suspension. Reinstatement of an account after a suspension will result in a charge to the subscriber of $3.00. Millenicom reserves the right to terminate or discontinue service at any time.
Returned Checks- A returned check charge of $25.00 will be incurred for all returned checks.
Payment- The subscriber is responsible for choice of service and is bound to remit payment.
It is understood that all billings are due on the date of the invoice, and it is agreed that all charges not paid within 10 days of the invoice date are subject to a $3.00 finance charge. When an account becomes more than 90 days past due it may be sent to our collection company for further collection action. In that event a finance charge of 1½ % per month (18% per annum) or the maximum allowed by law will be added to the account each month that the account continues to have a past due balance. In the event that any litigation is instituted for the collection of the above account or debt incurred, it is agreed by entering into this agreement that all but not limited to collection and court costs will be paid, including reasonable attorney’s fees / collection fees. By accepting the terms and conditions above certifies that the foregoing is a transaction, and waives its’ rights to a notice and hearing for a pre-judgment remedy.
Billing Disputes- All billing disputes, with Millenicom, must be received at our business office in writing, and the obligation to pay for service will continue until such notice is received. Termination of your service does not constitute relief from amounts incurred prior to termination. Agreements or contracts not on a monthly basis (annual, semi-annual, etc...) can be canceled in writing, by email, or by phone, but the subscriber will be obligated to pay any and all monthly fees until termination of the contract is finalized.
Mobile Broadband Equipment Issues- The client is responsible to alert our technical support team in a timely manner in the event there are issues with the equipment provided. Until such contact takes place Millenicom cannot be held responsible for service or product concerns. It is important the client document date, time and the technician spoken with, client should escalate unsatisfactory results to support@millenicom.com
Return Policy for Mobile Broadband Accounts- Customers who return their equipment immediately upon receiving it (within 24-hours) will be refunded the entire amount of their initial charges except for the shipping fee. Customers who have been told by Millenicom that their location is outside the service area and insist we move forward with their order anyway will also forfeit the activation fee.
Cancellation Policy for Mobile Broadband Accounts- The account will be considered closed during the calendar month the device is returned in proper working order in its original case with the original contents at MILLENICOM SHIPPING 1596 S Alpine St. Cornelius OR 97113. Monthly service payment is required in entirety for the calendar month the device is received. Failure to return the device upon cancellation will result in a $200.00 termination fee. Client must also use the cancel account support ticket system at https://members.millenicom.com/members or email billing@millenicom.com or send a letter via US Mail with contact information informing us of the desire to cancel. All cancellations must be made via Support Ticket or e-mail or the postal service so we can have exact record of the date and specific request of the customer.
Cancellation Policy- (Non-Mobile Broadband) Accounts: The account will be billed to the end of the present month. Cancellation requests must be received by the last day of the month in order to be cancelled for the next month. Any cancellation requests received on the 1st or after the 1st will be billed to the end of that month. Annual & Semi-annual accounts: There is no refund. All cancellations must be made via e-mail or the postal service so we can have exact record of the date and specific request of the customer.
Dial-up Numbers- On installation of the service the subscriber is responsible for inputting the appropriate number corresponding to their area of dial up service. Millenicom is not responsible for charges incurred by the subscriber for the inputting of the wrong dialup number.
Dial Up Line Condition- Millenicom uses state of the art, modern digital equipment for its internet/network services. Millenicom is not responsible for the deterioration of line speeds based on the location of the subscriber. 56K provides speeds significantly higher than 33,600 BPS for over 80% of local phone lines. Typical speeds range between 42 and 54 KBPS (the current limit set by the FCC)
Legality of Content- The subscriber agrees to use Millenicom for lawful purposes only. The subscriber will not post or transmit any material, through Millenicom, which violates or infringes upon the rights of other users. This includes, but is not limited to: threatening, abusive, defamatory, vulgar or obscene language, any action which threatens public or private rights or which is considered objectionable, any action which encourages a criminal offense, any action which gives rise to civil liability or violates any law. Attempts to gain unauthorized access to outside computer systems are expressly prohibited. Users agree to abide by any and all rules of the network they access through Millenicom. The subscriber agrees to defend and hold harmless Millenicom, its directors, officers, employees, agents or affiliates for all damages and claims that might arise from the subscribers use or misuse of the service, which damages or otherwise harms either the subscriber, Millenicom or a third party.
Dial Up Time Limits- Millenicom customers may not leave their PPP dial-up accounts connected for more than 24 hours at a time. This constitutes "nailing-up an account". Your PPP Personal account is intended for unlimited personal use: meaning, (and our definition is final) that you may have your connection up as long as you are personally in front of your PC. Your PPP Personal account is not a dedicated account. If you disregard this policy and leave your account up for more than 24 hours, your account will be terminated.
Dial Up Multiple Logins- Only one person, the subscriber, may use the PPP dialup account. Multiple or simultaneous logins will constitute forfeiture of the account and your account will be terminated.
Responsibilities- Millenicom makes no warranties, expressed or implied, regarding services provided. Millenicom is not responsible for any damages suffered from the use of our services, including but not limited to, loss of data, service interruptions and/or delays, or third party litigation.
Content Screening- Millenicom cannot and does not control the content of information available over the Internet. For this reason, the subscriber certifies that he/she is at least 18 years of age or, if the subscriber is a parent or guardian, he/she assumes all responsibility for supervising the on-line activities of the underage user. Any information garnered through Millenicom is done so at your own risk.
Unauthorized Connections- The subscriber shall not allow unauthorized connections to Millenicom, unauthorized reselling of Millenicom, or the solicitation of Millenicom users to become subscribers to other online service providers in competition with Millenicom, nor shall the subscriber make any unauthorized copies or duplications of any Millenicom material, advertising, forms, brochures, pamphlets and the like which is the property of Millenicom.
Relationship- The relationship between the subscriber and Millenicom is that of subscriber and service provider only. In the event of a violation of any terms and/or conditions set forth in this agreement, Millenicom reserves the right to immediately terminate the services provided to the subscriber.
Court Venue- In the event of a dispute, Millenicom and the subscriber agree that the venue for such litigation shall be Portland , Oregon and that the terms and conditions of this agreement shall be interpreted under the laws of the State of Oregon.
SPAM Policy- The transmission of any type of material, whether graphical or textual in content, to other subscribers or non-subscribers without their express consent is prohibited under the terms of this agreement. Any violations of our SPAM policy will result in immediate termination. Any complaints received from our subscribers or non-subscribers of unsolicited materials will result in a charge of $250.00 per complaint charged to the offending subscribers account automatically.
Unauthorized use of Millenicom Equipment- Any subscriber attempting to attack Millenicom equipment in any way will be billed at $500.00 per hour, with a minimum billable time period of 1 hour, to track the offending subscriber and repair any damage they may have caused.
